Welcome to Car Accident Helpline. These Terms of Service ("Terms") govern your access to and use of the website caraccidenthelpline.com and any related services (collectively, the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Nature of the Site — Not a Law Firm
Car Accident Helpline is not a law firm and does not provide legal advice. The Site is a paid attorney advertising platform. The sole basis for the inclusion of any participating lawyer or law firm is the payment of a fee for exclusive geographical advertising rights. Use of the Site does not create an attorney-client relationship. An attorney-client relationship can only be formed through a signed written retainer agreement with an attorney.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use the Site. By using the Site, you represent and warrant that you meet these requirements.
3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not:
- Submit false, misleading, or fraudulent information.
- Submit information for any person other than yourself without authority to do so.
- Use any automated means (bots, scrapers, etc.) to access or interact with the Site.
- Interfere with the Site's operation or security, or attempt to gain unauthorized access.
- Use the Site to transmit any unlawful, harassing, defamatory, or otherwise objectionable content.
4. Submissions and Lead Information
When you submit the intake form, you authorize Car Accident Helpline to share the information you provide with participating attorneys, law firms, and advocates in our advertising network for the purpose of evaluating your potential claim. We do not endorse, recommend, or make any representation about the qualifications of any participating lawyer.
5. Electronic Communications
By submitting your contact information, you provide express written consent for Car Accident Helpline and our network to contact you by phone (including autodialer and pre-recorded messages), SMS, email, and other electronic means at the contact information you provide, even if your number is on a Do-Not-Call list. Message and data rates may apply. Reply STOP to cancel SMS and HELP for help. Consent is not a condition of using our services.
6. Intellectual Property
All content on the Site — including text, graphics, logos, icons, images, and software — is the property of Car Accident Helpline or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written permission, except for personal, non-commercial use.
7. Third-Party Links and Services
The Site may link to or integrate with third-party websites and services. We do not control and are not responsible for the content, practices, or policies of those third parties.
8. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATION OR WARRANTY ABOUT THE OUTCOME OF ANY CASE OR THE QUALIFICATIONS OF ANY PARTICIPATING ATTORNEY.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CAR ACCIDENT HELPLINE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Car Accident Helpline and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right.
11. Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and Car Accident Helpline each waive any right to a jury trial or to participate as a plaintiff or class member in any purported class action or representative proceeding. The arbitration shall take place in your county of residence in the United States or another mutually agreed location.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, except where the laws of your state require otherwise.
13. Termination
We may suspend or terminate your access to the Site at any time, for any reason, with or without notice. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, arbitration) will survive.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date will reflect the most recent revisions. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
